1. Overview

This website is operated by PlantArt Gallery. Throughout the site, the terms “we”, “us” and “our” refer to PlantArt Gallery.

By visiting our website and/or purchasing or renting a product from us, you agree to be bound by these Terms & Conditions.

2. Nature of the Products

PlantArt pieces are living artworks.

Each piece contains natural elements such as plants, mosses, and organic materials. As a result:

  • Every artwork is unique
  • Natural variation, growth, and change over time are expected
  • The appearance at delivery may differ slightly from images or previous stages

These characteristics are an essential part of the product and are not considered defects.

3. Orders and Custom Work

PlantArt Gallery offers both ready-made and commissioned artworks.

For commissioned pieces:

  • Specifications are agreed upon in advance
  • Once production has started, the order cannot be cancelled
  • Custom works are non-refundable

We reserve the right to make minor adjustments to ensure the health and balance of the ecosystem.

4. Pricing

All prices are listed in the applicable currency and may be subject to change without notice.

Prices do not include additional services unless explicitly stated, such as:

  • Installation
  • Maintenance
  • Delivery or shipping

5. Shipping and Delivery

We take great care in packaging and delivering each artwork.

Due to the nature of living systems:

  • Minor changes during transport may occur
  • Plants may experience temporary stress during shipping

Delivery times are estimates and may vary depending on location and conditions.

6. Returns and Refunds

Due to the living nature of our products, returns are generally not accepted.

If your artwork arrives damaged:

  • You must notify us within 48 hours of delivery
  • Photographic evidence may be required

We will assess the situation and offer an appropriate solution where applicable.

7. Maintenance and Care Responsibility

Unless a separate maintenance agreement is in place, the customer is responsible for the care of the artwork after delivery.

We provide general care guidance, but we are not responsible for:

  • Changes caused by environmental conditions
  • Incorrect care or handling
  • Long-term plant development

8. Automation Systems

Some PlantArt pieces include or support automated systems.

These systems are designed to assist with care but do not fully eliminate the need for oversight. The customer remains responsible for:

  • Monitoring system performance
  • Ensuring water and environmental conditions are maintained

9. Rental Services

If a PlantArt piece is rented:

  • Ownership remains with PlantArt Gallery or the respective artist
  • The customer agrees to handle the artwork with care
  • Damage beyond normal wear may be charged

Rental terms, duration, and service conditions are defined in separate agreements where applicable.

10. Liability

PlantArt Gallery is not liable for:

  • Natural changes in plant appearance or growth
  • Environmental factors affecting the artwork
  • Indirect damages resulting from the use or placement of the artwork

Our liability is limited to the value of the purchased or rented product.

11. Intellectual Property

All designs, concepts, and content on this website remain the intellectual property of PlantArt Gallery or the respective artist.

They may not be copied, reproduced, or used without prior written consent.

12. Third-Party Artists

PlantArt Gallery may present and sell works created by third-party artists.

In such cases:

  • The artist remains the creator of the work
  • Specific conditions may apply depending on the artwork
